That's plausible but it can't happen this year or this case which instantly overturns the whole law. IANAL but I imagine if I were Roberts I'd send it back to Judge O'Connor to explain exactly how his ruling should be implemented without killing millions of people and jobs.

Right! So the Cali et al position is the individual mandate is "severable" from the rest of the act, so when Congress overturned it that didn't make ACA unconstitutional. SCOTUS can accept that without going all the way to admitting ACA IS constitutional. "Keep trying, guys!"

The quintessential Roberts decision and the reason I always thought ACA would survive this round. White House is stuck with transmitting Trump's emotions ("Make Obama go away!") in some kind of legally meaningful form, which is why their position is so weird and changeable.
